1. Acceptance of Terms

By creating an account, accessing, or using the services provided by zymplio.com (“Service”, “Platform”, “we”, “us”, “our”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

Zymplio is a web-based application designed to help WordPress developers manage their stack. The Service includes features such as:

  • License Management: Storing and managing WordPress plugin and theme license keys.

  • Code Snippets: A library for storing, organizing, and generating code snippets.

  • Architecture Tools: Custom Post Type (CPT) generators and architecture planning tools.

  • Utilities: Local WebP image conversion and other developer tools.

  • AI Integration: Use of Artificial Intelligence (Google Gemini) to assist in code generation and data parsing.

3. User Accounts

3.1 Registration

To use the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials (email and password). You are fully responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Eligibility

You must be at least 18 years old to use this Service.

4. Memberships and Payments

4.1 Plan Types

  • Free Plan: Provides limited access (e.g., maximum of 5 stored licenses).

  • Pro Plan: A recurring subscription (Yearly) that unlocks unlimited storage and advanced features.

  • Lifetime Plan: A one-time payment granting perpetual access to Pro features for the lifetime of the Service.

4.2 Payments

Payments are processed via our third-party payment provider, Stripe. By purchasing a plan, you agree to Stripe’s terms of service and authorize us to charge your selected payment method.

4.3 Refunds

Due to the digital nature of the Service (immediate access to software tools), all sales are generally final. Refunds are granted at our sole discretion or as required by Austrian consumer protection laws.

4.4 Cancellation

You may cancel your Pro subscription at any time via your account settings. Access to Pro features will continue until the end of the current billing cycle.

5. Use of Artificial Intelligence

The Service integrates with Google Gemini (AI) to generate code snippets and data structures.

  • No Warranty on AI Output: AI-generated code is provided “as is”. We do not guarantee that the code is bug-free, secure, or suitable for your specific production environment.

  • User Responsibility: You are solely responsible for reviewing, testing, and securing any code or architecture generated by the AI before deploying it to a live website.

6. Intellectual Property

6.1 Our IP

The zymplio.com platform, including its source code, design, logo, and algorithms, is the exclusive property of the Service provider.

6.2 Your Content

You retain full ownership of the data (license keys, snippets, CPT structures) you input into the Service. By using the “Cloud Library” or “Public” features, you grant us a license to display and share that specific content with other users of the platform.

7. Encryption and Data Security

We employ client-side and server-side encryption to protect your sensitive data (specifically license keys). While we use industry-standard security measures (AES-256-GCM), no method of transmission over the Internet or electronic storage is 100% secure. We cannot guarantee absolute security.

8. Prohibited Conduct

You agree not to:

  • Use the Service for any illegal purpose.

  • Reverse engineer, decompile, or disassemble any aspect of the Service.

  • Share your account credentials with others (Pro and Lifetime plans are strictly Single User Licenses).

  • Input malicious code or data designed to compromise the Service or other users.

9. Termination

We reserve the right to suspend or terminate your account immediately, without prior notice or liability, if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

10. Limitation of Liability

To the maximum extent permitted by applicable law, zymplio.com shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data (including license keys or code), use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service;

  • Any conduct or content of any third party on the Service;

  • Any content obtained from the Service (including AI-generated content).

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of Austria, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days’ notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

13. Data Processing and Sub-processors (DPA)

By using the Service, you acknowledge and agree that we engage third-party service providers (“Sub-processors”) to process your data on our behalf. These Sub-processors are essential for the delivery of the Service (e.g., hosting, payment processing, database management). We have entered into Data Processing Agreements (DPA/AVV) with these providers to ensure compliance with applicable data protection laws (GDPR).

Our current Sub-processors include:

  • Supabase: For database management, user authentication, and backend infrastructure.

  • Stripe: For secure payment processing and billing management.

  • Hostinger: For web hosting and content delivery.

Your data may be processed in locations determined by these providers, subject to their respective privacy policies and robust security measures.
